By accessing or using our website at yushutechdev.com (the "Site"), our mobile applications published on Google Play Store and Apple App Store (the "Apps"), or any of our services, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use our services.

These Terms constitute a legally binding agreement between you and YUSHU TECH. By using our services, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy.

9.1 App Store Terms

Our mobile applications are available through Google Play Store and Apple App Store. Your use of our apps is subject to:

9.2 App Updates

We may automatically check for updates and require you to download and install updates to continue using our apps. By downloading our apps, you consent to such automatic updates.

We do not warrant that:

13. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, YUSHU TECH SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

• Your access to or use of (or inability to access or use) our services
• Any conduct or content of any third party on our services
• Any content obtained from our services
• Unauthorized access, use, or alteration of your transmissions or content

OUR TOTAL LIABILITY FOR ANY CLAIMS ARISING OUT OF OR RELATING TO OUR SERVICES SHALL NOT EXCEED THE AMOUNT YOU PAID US FOR THE APPLICABLE SERVICE IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

14. Indemnification

You agree to defend, indemnify, and hold harmless YUSHU TECH and its officers, directors, employees, contractors, agents, licensors, suppliers, successors, and assigns from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to your violation of these Terms or your use of our services.

15. Termination

We may terminate or suspend your access to our services immediately, without prior notice or liability, for any reason, including without limitation if you breach these Terms. Upon termination, your right to use our services will cease immediately.

Provisions that by their nature should survive termination shall survive, including but not limited to ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

16. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the People's Republic of China, without regard to its conflict of law provisions. Any disputes arising out of or relating to these Terms shall be subject to the exclusive jurisdiction of the courts located in Beijing, China.

17. Dispute Resolution

17.1 Informal Resolution

Before initiating any formal dispute resolution, you agree to first contact us at support@yushutechdev.com to attempt to resolve any dispute informally.

17.2 Arbitration

For users in certain jurisdictions, any dispute that cannot be resolved informally may be submitted to binding arbitration under the rules of the China International Economic and Trade Arbitration Commission (CIETAC) or other mutually agreed arbitration institution.

17.3 Class Action Waiver

You agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action.

18. Age Restrictions for Apps

Our mobile applications may have different age ratings based on content:

• General Audiences (All Ages): Apps suitable for all ages without restrictions
• Parental Guidance Suggested: Apps that may contain mild content
• Teen: Apps suitable for users 13 years and older
• Mature 17+: Apps containing mature themes, not suitable for minors
• Adults Only 18+: Apps containing adult content, restricted to users 18 years and older

Age ratings are assigned according to Google Play Store and Apple App Store guidelines and may vary by region. You are responsible for ensuring that minors do not access age-restricted content.

We comply with applicable laws and regulations in all regions where we operate, including but not limited to:

20. Changes to Terms

21. Severability

If any provision of these Terms is held to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect. The invalid or unenforceable provision shall be modified to the minimum extent necessary to make it valid and enforceable.

These Terms, together with our Privacy Policy and any other legal notices published by YUSHU TECH, constitute the entire agreement between you and YUSHU TECH regarding your use of our services and supersede all prior agreements, understandings, representations, and warranties.
